STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br />INTERLOCAL AGREEMENT <br />FOR SECONDARY PSAP FUNDING <br />This INTERLOCAL AGREEMENT FOR SECONDARY PSAP FUNDING <br />( "Agreement "), permitted by N.C. Gen. Stat. § 160A -460 et seq., is made as of the I" day of July, <br />2014 by and between CABARRUS COUNTY ( "County ") and the CITY OF KANNAPOLIS, <br />North Carolina ( "City"). <br />RECITALS <br />The County owns and operates a 911 call center, which call center is designated a <br />primary Public Safety Answering Point ( "PSAP ") as defined under Chapter 62A of the North <br />Carolina General Statutes ( "Primary PSAP "). <br />2. The City owns and operates a 911 call center, which call center is designated a <br />secondary PSAP, as defined under Chapter 62A of the North Carolina General Statutes <br />( "Secondary PSAP ") and is part of the County's 911 system. <br />3. The North Carolina 911 Board ( "911 Board "), based on recommendations from <br />its Secondary PSAP 911 Funding Committee, dated November 13, 2013, enacted a policy <br />concerning the receipt and disbursement of Secondary PSAP funding. <br />4. Inter alia those recommendations and the ensuing policy require an interlocal <br />agreement between the primary PSAP entity and the secondary PSAP entity regarding <br />disbursements from the 911 Fund. <br />5. This document is the above- referenced and required interlocal agreement between <br />these parties. <br />In consideration of the foregoing Recitals and the Terms expressed below, which the <br />parties acknowledge constitutes sufficient consideration to make this Agreement legally binding <br />and enforceable, the parties agree as follows, <br />TERMS <br />1. The parties to this Agreement have a prior interlocal agreement defining and <br />assigning responsibilities for answering and responding to 911 calls in their respective <br />jurisdictions. <br />2. It is understood and agreed that the 911 Fund disbursements allocated to the City <br />by the 911 Board will be identified by the Board and provided to the City by the County, <br />pursuant to and conditioned upon compliance with the Board's policy regarding such funding <br />and disbursements. <br />Attachment number 2 <br />F -10 Page 135 <br />
