Prepared By/Return to: Costner Law Office, PLLC, 10150 Mallard Creek Rd., Suite 106, Charlotte, NC 28262 <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br />GRANT OF RIGHT OF WAY <br />AND <br />EASMENT AGREEMENT <br />• Portion of PIN: 5527713127 (Parcel "A ") <br />• Portion of PIN: 5527601870 (Parcel "B ") <br />THIS GRAND OF RIGHT OF WAY AND EASEMENT (hereinafter referred to as the <br />"Agreement ") is made as of this day of , 2013 by and between <br />CABARRUS COUNTY, a political subdivision of North Carolina ( "GRANTOR ") and NVR, INC., a <br />Virginia Corporation ( "GRANTEE "). <br />The designations GRANTOR and GRANTEE, as used herein, shall include said parties, their <br />heirs, successors, representatives, and assigns, and shall include singular, plural, masculine, feminine, or <br />neuter as required by context. <br />WITNESSETH: <br />WHEREAS, said GRANTOR owns a certain tracts of land (hereinafter collectively referred to as <br />the "Tract ") in the City of Concord, County of Cabarrus, North Carolina, which Tract is identified by the <br />tax parcel numbers above and depicted on that certain plat dated February 5, 2008, prepared by THE <br />ISAACS GROUP, attached hereto as Exhibit B. <br />WHEREAS, GRANTEE desires to obtain and GRANTOR agrees to grant certain permanent and <br />temporary easements and rights -of -way as to portions of the Tract as more specifically set forth below <br />and shown on the SEWER ACCESS EASEMENT OF PARCEL "A ", CABARRUS COUNTY, attached <br />hereto as Exhibit A. <br />NOW THEREFORE said GRANTOR, for good and valuable consideration to be paid by <br />GRANTEE, has bargained and sold, and by these presents does grant, bargain, sell, convey, remise, <br />release and quitclaim to said GRANTEE and its successors, assigns and licenses, a non - exclusive, <br />perpetual, privilege, right of way and easement to enter and re -enter at any time and to install, dig, build, <br />F -6 Page 296 <br />
