PETITION 97-06(S) <br /> <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> SUBDIVISION REGULATIONS <br /> <br />BE IT ORDAINED that the Cabarrus County Subdivision Regulations is hereby <br />amended as follows: <br /> <br />Amend Section 66-72 "Sedimentation Pollution Control" <br /> <br />Delete existing text and add text to read: <br /> <br />"All subdivision developments must meet the requirements of the Cabarrus <br />County Sediment and Erosion Control Ordinance. The approval of a sediment <br />and erosion control plan for major developments must be received within 60 <br />days of preliminary subdivision approval. No site work may begin in a <br />subdivision until that approval is granted. <br /> <br />Final subdivision approval may not be granted to any subdivision that is not in <br />conformance with the Sediment and Erosion Control Ordinance. <br /> <br />Add a new Section 66-80 "Reservation of School Sites" <br /> <br />Schools sites must be reserved within the agreement of the Board of Education, <br />in accordance with adopted plans of the Planning and Zoning Commission <br />and/or Cabarrus County Board of Commissioners. Whenever a subdivision <br />includes all or part of a site identified for new school construction, the Board of <br />Education notified. That Board shall then notify the Planning and Zoning <br />Commission whether it still wishes the site to be reserved. If the Board of <br />Education does not wish for it to be reserved, no reservation will be required. If <br />that board wishes for the site to be reserved the subdivision may not be <br />approved without that reservation. The Board of Education must acquire the <br />site within 18 months of the date of reservation. If the Board of Education has <br />not acquired the site or begun the proceedings to condemn the site within the 18 <br />months, the land is freed of the reservation. <br /> <br />Add new Section 66-81 "Adequate Public Facilities Standards" <br /> <br />To ensure public health, safety and welfare the Planning and Zoning <br />Commission shall review each subdivision, multi-family development, and <br />mobile home park to determine if public facilities are adequate to serve that <br />development. <br /> <br /> <br />
