It was recognized in the area plan that this was an area of potential conflict <br />where a division between residential and non-residential uses would need to be <br />defined. The plan states that in areas of potential conflict between residential <br />and employment areas that there will need to be an" .... approval process for the <br />zoning, use or both ... and preference should be given to plans that address <br />conflict, offer gradual transition from one use to another, and those in which <br />standards are applied by the developer to enhance the property while protecting <br />adjoining owners." <br /> <br />The area along Derita Road is one in which potential conflict was recognized. At <br />the time of the adoption of the current zoning ordinance, the line between the <br />non-residential zoning and residential was placed through the middle of one of <br />the properties included in this petition. <br /> <br />The plan also recognized that as the effects of the airport and Kings Grant were <br />realized that this area would need to be re-examined and the boundary between <br />residential and non-residential areas considered. <br /> <br />ANALYSIS <br /> <br />The Western Area Plan shows that citizens, planners and elected boards clearly <br />recog~i?ed there would be areas of conflict between residential and non- <br />residential uses. The difficulty in analyzing this rezoning is in defining what <br />uses are proper for this property, addressing community needs, and in <br />mitigating possible conflict. <br /> <br />These properties are not appropriate for complete residential developmenL The <br />airport facility, development and zoning trends, and larger community needs do <br />not support the use of this land for residential development for one to four units <br />per acre. As has bc~n shown, the airport has seen great increases in use and in <br />aircraft based there. Rezonings in the area have been from residential to non- <br />residential with the exception of the mixed project to the north. Residential use <br />on this land would create further conflict with the airport and with other non- <br />residential developmenL <br /> <br />There is a defined need in the community to identify and protect areas for <br />business and industrial development. The best areas for this type of <br />development are those in which proper services exist, are planned, or can be <br />provided. It is also important that new areas be in the general location of other <br />non-residential uses. The proximity of this property to the airport is also a <br />positive factor. <br /> <br /> <br />
