I <br /> I 8. Amendment. This Agreement may be amended only by a <br /> <br /> Iwritten document duly executed by the parties hereto. <br /> <br /> 9. Entire Agreement. This instrument contains the entire <br /> I Agreement between the parties, and no statement, oral or written, <br /> made by either party or agent of either party that is not <br />I contained in this written Agreement shall be valid or binding. <br /> <br /> I 10. Remedies. <br /> (a) This Agreement shall be enforceable by each party <br /> I hereto by all remedies available at law or in equity, including <br /> but not limited to specific performance. Failure or delay to <br /> exercise any right, remedy or privilege hereunder shall not <br /> <br /> I operate as a waiver of such right, remedy or privilege nor <br /> prevent subsequent enforcement thereof. <br /> <br /> I (b) Failure of the County to obtain State approval of <br /> <br /> the Solid Waste Management Plan and designation of the geographic <br />I area pursuant to N.C. Gen. Stat. 130A-294, renders this Agreement <br /> <br />i null and void. <br /> (c) Between the parties hereto, if any conflicts or <br /> <br />Iinconsistencies exist between this Agreement and the Solid Waste <br /> <br /> Management Plan, and the Solid Waste Ordinance, the provisions of <br />I this Agreement shall control. <br /> <br />i 11. Duplicate Originals. This Agreement shall he executed <br /> by the parties hereto in duplicate originals, each of which, when <br />I executed, shall constitute one and the same Agreement. <br /> <br /> <br />
