As currently presented, Staff cannot use the landscape plan to perform a site compliance <br />inspection as existing trees, shrubs, etc. to be used towards required plantings have not been <br />clearly identified on the plan. The plan does not meet the standards of the Ordinance <br />established in the Landscape Standards. (See Landscape Ordinance Extraction). <br /> <br />c. An emergency plan showing how possible spills, explosions, etc. would be handled. An updated <br />plan has been submitted for the project. <br /> <br />d. Maximum permitted noise levels may be established in order to protect adjacent properties. <br />Any such requirement will be made a part of the conditional use permit which may also specify <br />the measures to be taken to control noise, including but not limited to muting, special <br />landscape treatment and berms. The original application stated that sound levels generated by <br />the equipment, as measured at the property lines, would not exceed 35dba. Since existing <br />vegetation along the project boundary was removed, the original study had to be revised. The <br />application states that the closest inverters and transformers are located approximately 229 <br />feet from project boundary with a majority at 400 to 900 feet from the edge of the fence line. <br />The study shows that noise levels at points along the property line will reach 40dba. To mitigate <br />this change from the original approval of 35dba, the applicant is proposing to install a sound <br />wall that varies between 13 feet and 24 feet around the substation. The facility's lighting shall be shielded to prevent light and glare spill-over on to any adjacent <br />residentially used or zoned properties, if such exist. Applicant provided a lighting study, <br />photometric plan and typical of proposed lighting. The application states that only substation <br />lighting will be utilized. The application also states that the lighting at the property line is <br />equivalent to an average 0.0 footcandles. See Substation Lighting Plan. <br /> <br />f. When a building is involved and will be located in a residentially zoned district, it shall have a <br />residential appearance or the appearance of other buildings allowed as a matter of right in this <br />district. The application states that there will be two sub-station control buildings on the site. <br />No photos or renderings were provided. <br /> <br />g. In the event the facility abuts residential property, a Level Two buffer must be implemented. A <br />Level One buffer is required for this project because it is a solar farm. A proposed landscape <br />plan has been submitted for the Board of Adjustment to consider as a means to remedy <br />multiple buffer encroachments on the subject property. Submittal materials from 2017 stated <br />that existing vegetation along the perimeter of the project would remain undisturbed, be used <br />towards the required buffer and would be supplemented as needed in accordance with the <br />Ordinance. This was incorporated into the conditions of approval and is noted as Condition #6 <br />and Condition #18 in the Granting Order. <br /> <br />The current site plan shows multiple encroachments of racking and fencing in the required 100 <br />foot buffer and 100 foot setback.
