d. As currently presented, Staff cannot use the landscape plan to perform a site compliance
inspection as existing trees, shrubs, etc. to be used towards required plantings have not been
clearly identified on the plan. The plan does not meet the standards of the Ordinance
established in the Landscape Standards. (See Landscape Ordinance Extraction).

c. An emergency plan showing how possible spills, explosions, etc. would be handled. An updated
plan has been submitted for the project.

d. Maximum permitted noise levels may be established in order to protect adjacent properties.
Any such requirement will be made a part of the conditional use permit which may also specify
the measures to be taken to control noise, including but not limited to muting, special
landscape treatment and berms. The original application stated that sound levels generated by
the equipment, as measured at the property lines, would not exceed 35dba. Since existing
vegetation along the project boundary was removed, the original study had to be revised. The
application states that the closest inverters and transformers are located approximately 229
feet from project boundary with a majority at 400 to 900 feet from the edge of the fence line.
The study shows that noise levels at points along the property line will reach 40dba. To mitigate
this change from the original approval of 35dba, the applicant is proposing to install a sound
wall that varies between 13 feet and 24 feet around the substation. See Kimley-Horn CUP Plans
for placement of wall. See Armtec drawings for wall details. See Noise Study for additional
details.

e. The facility's lighting shall be shielded to prevent light and glare spill-over on to any adjacent
residentially used or zoned properties, if such exist. Applicant provided a lighting study,
photometric plan and typical of proposed lighting. The application states that only substation
lighting will be utilized. The application also states that the lighting at the property line is
equivalent to an average 0.0 footcandles. See Substation Lighting Plan.

f. When a building is involved and will be located in a residentially zoned district, it shall have a
residential appearance or the appearance of other buildings allowed as a matter of right in this
district. The application states that there will be two sub-station control buildings on the site.
No photos or renderings were provided.

g. In the event the facility abuts residential property, a Level Two buffer must be implemented. A
Level One buffer is required for this project because it is a solar farm. A proposed landscape
plan has been submitted for the Board of Adjustment to consider as a means to remedy
multiple buffer encroachments on the subject property. Submittal materials from 2017 stated
that existing vegetation along the perimeter of the project would remain undisturbed, be used
towards the required buffer and would be supplemented as needed in accordance with the
Ordinance. This was incorporated into the conditions of approval and is noted as Condition #6
and Condition #18 in the Granting Order.

The current site plan shows multiple encroachments of racking and fencing in the required 100
foot buffer and 100 foot setback. For the current plan to be approved as submitted, variances
