GA. <br />CABARRUS COUNTY <br />1"BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />April 15, 2024 <br />6:30 PM <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />County Manager - Restructure Department of Social Services Legal Services <br />BRIEF SUMMARY: <br />The Department of Social Services requires legal representation, which has been provided <br />for several years through a contract with Hartsell & Williams. However, due to various <br />considerations, County staff proposes a return to in-house legal support for the department. <br />This shift aims to enhance accessibility, reduce costs, and afford greater control over this <br />critical function. <br />Two options were presented at the Work Session for the Board's consideration option 1) <br />hiring two attorneys and gradually eliminating use of contracted legal services for DSS <br />programs and option 2) hiring one attorney to manage two of the three DSS programs, while <br />continuing use of contracted legal services for the third program. <br />If approved, staff commits to collaboratively work with Hartsell & Williams to develop an <br />effective transition plan. The position will be promptly posted and filled to ensure a seamless <br />transition. <br />In the current fiscal year, where Hartsell & Williams will continue rendering services, costs <br />associated with the in-house position will be covered from lapsed salary. Following the <br />conclusion of the contract on June 30, 2024, funds will be included in the FY25 budget. <br />REQUESTED ACTION: <br />Staff Recommendation: <br />Motion to authorize bringing DSS legal services in-house and the creation of two full-time <br />staff attorney positions. <br />Page 86 <br />
