<br />First Amendment <br /> <br />to <br /> <br />Lease Agreement between KannapoJis Land, Inc. <br />and Cabarrus County <br /> <br />This First Amendment is made and entered into this _ day of <br />by and between KannapllJis Land, Inc., a North Carolina corporation <br />Cabarrus County, a govermnentaJ entity ("Tenant"). <br /> <br />,2006, <br />("Landlord") and <br /> <br />Landlord and Tenant entered into a Lease Agreement (the "Lease") dated December 1, <br />1996: Landlord has agreed to perform certain maintenance and repair work on the Demised <br />Premises, and Landlord and Tenant have agreed to extend the term of the Lease. This First <br />Amendment is entered by Landlord and Tenant in consideration of the mutual covenants and <br />agreements set forth herein. <br /> <br />1. Notwithstand~g the provisions of the Lease, including but not limited to Section <br />7 thereof, Landlord agrees. to perform the following maintenance and repair work on the <br />Demised Premises: <br /> <br />a) Landlord will proceed with the major improvements to the building and parking lots in <br />accordance with the architects and engineers recommendations with a goal of completion <br />within 4 to 5 months after approval from Tenant 'I}e said improvements to include the <br />fo 110 wing: <br /> <br />· Parking Lot Lighting - Forty new rc;h" with two on each pole and all poles shall <br />be painted or, if damaged, replace.,;. <br />· Parking Lot Asphalt - The entire parking lot including the front and back of the <br />facility will have an asphalt overlay with new parking lot striping and directional <br />arrows. New ~ustom stop signs shall be included. <br />· Sidewalk - The entire front sidewalk shall receive an overlay for an "as new" <br />appearance (s4nilar to what is often found in aircraft hangers). <br />· Exterior Painting - The exterior of the building shall be painted in its entirety and <br />Tenant shall s~lect the color or color patterns. <br />· Building - The front of the building shall be renovated to include a new brick <br />tower at the I!lIlin entrance to create a tower larger, but similar, to the rest of the <br />shopping center, and an additional new tower for the Health Alliance area with a <br />smaller tower i that also will be similar to the existing shopping center.
