NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />NORTH CAROLINA DEPARTMENT <br />OF TRANSPORTATION <br /> <br /> AND <br /> <br />COUNTY OF CABARRUS <br /> <br />02/28/02 <br /> <br />CONSTRUCTION AGREEMENT <br />PROJECT: 6.660010 <br /> <br /> THIS AGREEMENT, made and entered into this the day of , <br /> <br />20 , between the DEPARTMENT OF TRANSPORTATION, an agency of the State of <br /> <br /> North Carolina, hereinafter referred to as the Department, and the COUNTY OF <br /> CABARRUS, hereinafter referred to as the County; <br /> <br /> WI T N E S SETH: <br /> <br /> WHEREAS, the County has plans to make certain street and highway constructions <br /> and improvements within the County under Project 6.660010, Cabarrus County, said plans <br /> consisting of the realignment of Christenbury Road (SR 1447) to align with Concord Mills <br /> Boulevard in Cabarrus County. Alignment begins at a point south of Beard Road (SR2893) <br /> and proceeds 1456 feet to Derita Road (SR 1445) which includes grading, base, drainage, <br /> paving and erosion control; said project having a right-of-way width as shown on the project <br /> plans on file with the Department's office in Albemarle; North Carolina; and, <br /> <br /> WHEREAS, the Department has approved the construction of said project an~l has <br />· agreed to participate in the cost of the project as hereinafter set out. <br /> <br /> NOW, THEREFORE, the parties hereto, each in consideration of the promises and <br /> undertakings of the other as herein provided, do hereby covenant and agree, each with <br /> the other, as follows: <br /> <br /> <br />
