The Collector shall not charge any fee for recyclable materials delivered to the <br /> facility. <br /> <br /> E. Disposal Fee <br /> <br />The rate of payment to the Collector by the City of Kannapolis and the Towns of Mount <br />Pleasant and Harrisburg for provision of residential municipal solid waste disposal <br />services to the City of Kannapolis and the Towns of Mount Pleasant and Harrisburg at <br />the Disposal Facility shall be: <br /> <br /> $ 27.00 per ton plus the Franchise Fee <br /> <br />If, for any reason, residential municipal solid waste cannot be accepted at the CMS <br />Landfill, then the Collector will dispose of the solid waste governed by this Franchise <br />and be entitled to the then existing Disposal Fee plus any additional transportation cost <br />incurred by the Collector in the transfer of such waste to an alternative, properly <br />permitted disposal site; provided that, ifa less expensive means of transfer and/or <br />disposal is available to the County by a provider other than the Collector, the County may <br />cause its residential municipal solid waste to be disposed of by that provider without <br />penalty or reprisal. <br /> <br />If residential municipal solid waste cannot be accepted at the CMS Landfill, the Collector <br />will provide written, advance notice to the County as early as possible. <br /> <br />F. Special Services <br /> <br />In the event Collector is requested to provide Special Services, it may do so but is not <br />required to do so. Such services will be provided upon such rates and other terms as may <br />be agreed upon between the Collector and the Customer requesting the Special Service. <br /> <br />8.2 <br /> <br />Rate Adjustments <br /> <br />The rates specified in Section 8.1 of this Agreement shall represent the rates during the <br />first year of the Agreement. These rates may be adjusted annually by a percentage equal <br />to the most recently released Consumer Price Index. <br /> <br />The Consumer Price Index used shall be the Consumer Price Index, United States <br />Average for all items Portion, New Series, for Urban Wage Earners and Clerical <br />Workers, as published by the United States Department of Labor. <br /> <br />The rates specified in Section 8.1 may also be adjusted to reflect additional direct costs <br />incurred by the Collector in the collection or disposal of solid waste pursuant to this <br />Franchise as the result of changes to federal, state or local laws, ordinances, rules or <br />regulations. <br /> <br />13 <br /> <br /> <br />
