Any rate adjustment shall be subject to the provision of thirty (30) days advance written <br />notice to the County and the Customers. <br /> <br />8.3 Billing <br /> <br />The Collector shall be responsible for billing and collecting on all residential and special <br />services. The Collector shall use his customary billing and collection procedures and in <br />accordance with customary business practices of the industry. <br /> <br />The Collector may deny collection and disposal service to any customer who does not <br />pay his bill following reasonable notice to the customer that the account is in arrears. <br />The Collector may pursue all reasonable and legal avenues to secure payment of any <br />account in arrears in their payment to the Collector. <br /> <br />8.5 Franchise Fee <br /> <br />The Collector shall pay, to the County, a Franchise Fee on a quarterly basis for all <br />residential and from-end loader commercial solid waste collected by the Collector in the <br />unincorporated areas of the County and disposed of by the Collector and also for the <br />residential waste generated in the municipalities of Kannapolis, Mount Pleasant and <br />Harrisburg delivered to the CMS landfill from Kannapolis, Mount Pleasant and <br />Harrisburg. The Franchise Fee shall be set and may subsequently adjusted annually by <br />the Board. The amount of the Franchise Fee may not exceed the difference of the then <br />existing gate rate at the CMS Landfill and the disposal fee charged by the Collector to the <br />City and Towns for disposal services as found in Section 8.1 (E); provided that the <br />franchise fee shall not be less than $1.00 per ton unless the Board approves a lower <br />franchise fee.
