STAFF ANALYS/S - PETITION 97-19 <br /> <br />The petitioners are requesting a change in zoning for ten parcels along Derita <br />Road in western Cabarrus County. The request is to change the zoning from <br />Medium Density Residential ancO. Limited Industrial to General Industrial <br />Special Use. There are approximately 440 acres total within the parcels <br />requested for rezoning. <br /> <br />The analysis that follows will include background information, factors affecting <br />the zoning of these properties, and conclusions based on those two items. The <br />important background items are the specific request, existing development and <br />zoning, trends for both, and larger community issues. One of the factors that <br />most directly affects zoning is infrastructure such as transportation facilities, <br />water and sewer. Other items that will be reviewed are the area plan affecting <br />this property, the effect on the area immediately surrounding these parcels, <br />community needs, and the specific proposal. <br /> <br />BACKGROUND <br /> <br />The rezoning request is for a General Industrial Special Use zoning. The special <br />use process allows petitioners to specify a single use, a group of uses, or to <br />exclude some of the uses typically pe,-..dtted in the requested zoning category. It <br />also petmits the submission of a concept plan and development conditions. <br />Additional conditions may be considered if they are related to land use and the <br />petitioners agree to them. <br /> <br />This petition includes a concept plan, conditions included with that plan, and <br />the exclusion of some of the uses typically petc. iitted within General Industrial. <br />A reduced copy of the concept plan is attached for review. It shows the <br />petitioners proposal to develop the property in a unified manner as an industrial <br />park. It also shows the property being developed into lots of no less than seven <br />acres with a main spine road to provide access, although there are rear access <br />points from some of the lots directly to Derita Road. A list of requested <br />excluded uses is attached as is a comparison of the requested .GI-SU zone to the <br />Limited Industrial zoning districL It is important to note that the concept plan, <br />conditions and possible uses will be binding on the petitioners if the rezoning is <br />approved. Those items will remain binding on the property if it is sold to a <br />single owner or developed separately by the individual owners. <br /> <br />The area surrounding these parcels is predominantly residential, rural <br />residential, or vacant at this time. To the east of the property are two <br />subdivisions, Twin Creeks and Misty-wood, an industrial/business that has just <br /> <br /> <br />
