Planning and Zoning Commission Minutes <br />July 17, 1997 <br /> <br />Page 3 <br /> <br />The Chair introduced the second item on the Agenda, Right-of-Way Variance <br />Request: <br /> <br />o <br /> <br />Applicant: Mr. Donald H. Sherman <br /> <br />Request: Variance Exception <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Mr. Donald H. Sherman for a right-of-way <br />variance from the requirements .in the Cabar~as Count~ <br />Subdivision Ordinance. <br /> <br />Mr. Michael L. Byrd, Transportation Planner, addressed the Board <br />stating the Cabarrus County Subdivision Ordinance requires 45 <br />feet of right-of-way for lots that do not have existing road frontage. <br />He said the Sherman's are requesting a variance from this. They <br />have 34.68 feet from their property out to the LaForest Lane. They <br />are not able to acquire property to widen the right-of-way to the 45 <br />feet required. <br /> <br />Mr. Donald H. Sherman, Applicant, addressed the Board stating <br />this property has been in existence for sometime. The road that <br />comes in off LaForest, he owns an acre on that road, but he do not <br />have enough space for a right-of-way. <br /> <br />There being no further comments, Mr. Kiefer MOTIONED, <br />seconded by Mr. Drye to approve the right-of-way exception. The <br />vote was unanimous. <br /> <br />The Chair introduced the third item on the Agenda, Zoning Atlas Amendment, <br />Petition 97-12: <br /> <br />Applicant: Cabarrus County Planning & Zoning Staff <br />Request: Zoning Atlas Amendment <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from the Cabarrus County Planning and Zoning Staff <br />to recognize changing goals and needs of Northwest Cabarrus <br />County. <br /> <br /> <br />
