Planning and Zoning Commission Minutes <br />July 17, 1997 <br /> <br />Page 4 <br /> <br />Mr. Jonathan B. Marshall, Planning Services Director, addressed <br />the Board presenting Petition 97-12 stating this is the third time the <br />staff has come before the Board with this issue. He said this is the <br />recommendation by staff in response to some community concerns <br />that an area in the northwest part of the County be rezoned from <br />Agricultural Open to Low Density Residential. It is approximately <br />3,181 acres. There have b~e,n no previous rezonings within this <br />entire area since the adoption of the 1993 zoning ordinance. Mr. <br />Marshall said one of the primary, effects of that is that single wide <br />mobile homes will no longer be permitted there. Double wides <br />will be permitted by standard, which means that it will have to <br />have masonry skirting. He said there will also be some changes in <br />the types of businesses that will be peta~itted. Staff recommends <br />approval. <br /> <br />The Chair said to Mr. Marshall for the benefit of the audience, tell <br />them how their existing lives will be affected by this rezoning. <br /> <br />Mr. Marshall said any current existing use that conforms with <br />zoning currently or may be nonconforming currently, if the <br />rezoning makes them nonconforming, that use can continue. Fie <br />said a more intensive change of that nonconforming use would <br />come before this board as a Board of Adjustment. You would have <br />two options to make modifications to those existing nonconforming <br />businesses. Mr. Marshall said with most rezonings they can end <br />before this board if it is a 75% majority, but because of this scope <br />and size of this rezoning, we are going to automatically send it to <br />the Board of Commissioners at their August meeting. <br /> <br />The Chair opened the Public Hearing on Petition 97-12. <br /> <br />Mr. Tony Barnhardt, Resident, addressed the Board stating he just <br />bought 12.36 acres out in the area. He said he is concerned about <br />dropping agricultural from it. <br /> <br />The Chair asked Mr. Marshall to address Mr. Barnhardt's concern. <br /> <br />Mr. Marshall said because of concerns like Mr. Barnhardt and other <br />far,-.iers, farming and agricultural uses and timbering uses are <br />exempt from zoning requirements. He said whether this be zoned <br />agricultural open or industrial, agricultural uses are exempt. <br /> <br /> <br />
