Mr. Joseph Joyle, Sr., addressed the Board stating he has a question for Mr. <br />Koch. He asked if this goes to a higher court and all three judges vote the same <br />is that it? <br /> <br />Mr. Koch said that is not necessarily true. He said the court of appeals sits in <br />three judge panels, but they can have a split decision. It can still be appealed to <br />the Supreme Court. Whether the vote is 2 to 1 or 3 to 0 is does not matter. If it is <br />a split opinion, it automatically goes up, but it can still be appealed by one or the <br />other party. <br /> <br />Mr. Joyle said the zoning on 601 South at Cal Bost Road is going to end the same <br />way the zoning on U.S. 601 South at Jim Sos$oman Road, in court~ He said the <br />Midland residents at the meeting had a wish list_ Mr. Joyle said they promote <br />the changes for structured growth and planned development, long term <br />situations, a strong reinforcement, and support of managed growth will benefit <br />elected officials, county residents, and business and residents would support all <br />of the above. <br /> <br />Ms. Cathy Spencer, Property Owner, addressed the Board stating this is nothing <br />but residential and they do not want commercial. She said they are going to <br />fight Mr. Wilson with this. They are not going to have a business put up there if <br />she can help it. She said they would really like the Board's help on this <br />rezoning. <br /> <br />Mr. Graham Copeland, Property Owner, addressed the Board stating he lives at <br />10350 Jim Sossoman Road. In the 1970's, Jim Sossoman Farm was purchased and <br />there were 140 acres more or less and due to this, there was 14 homes put on this <br />farm and all the lots were 2 acres or more. Mr. Copeland said they do not need <br />any business there. <br /> <br />Mr. George Spencer, Property Owner, addressed the Board stating this is his <br />home. He said this is a family residential area, not a commercial area. It is <br />currently zoned as a low density residential area and they wish to keep it that <br />way. <br /> <br />Mr. James Peterman, Petitioner, addressed the Board stating he would like to <br />make a couple points about this petition. He said he can understand all of the <br />people and what they are thinking. He said first of all he proposes to put a <br />business somewhat off the highway so it would not be visible. Mr. Peterman <br />said his proposal is to use this to build a building from which he can operate his <br />business. He said his business is currently located in Mecklenburg. Mr. <br />Peterman said he thinks his request to put a business on this land is perfectly <br />reasonably for this reason. The land on Highway 601 is not particularly suitable <br />or desirable for new residential development, although it is currently zoned for <br /> <br /> <br />
