2. The County, at its own expense and without any cost or liability whatsoever <br /> <br />to the Department, shall provide all necessary right of way and easements required, shall <br />provide all necessary fight of way and easements required for the project and shall <br />remove from said rights of way all obstructions and encroachments of any kind or <br />character with the exception that the County shall secure an encroachment agreement for <br />any utilities (which shall remain or are) to be installed within the right of way as required <br />by the Department's "Policies and Procedures for Accommodating Utilities on Highway <br />Rights of Way" dated April 1, 1993. Further, the County shall indemnify and save <br />harmless the Department from any and all claims for damages that might arise on account <br />of the acquisition of right of way, drainage and construction easements for the <br />construction of said project in accordance with the plans on file with the department. If <br />during construction of this project contaminated and/or hazardous material is discovered <br />or becomes known to the Department, the County shall be solely responsible for the <br />removal and disposal of said material at their expense. The County shall be solely <br />responsible for any damages caused by the existence of said material now and at any time <br />in the future and will save the Department harmless from any legal actions arising as a <br />result of this contaminated and/or hazardous material. Furthermore, upon execution of <br />this agreement, the County shall be responsible for ensuring compliance with all State, <br />Federal, and local environmental laws, regulations and ordinances and shall indemnify <br />the Department against any fines, assessments or other penalties resulting from non- <br />compliance. <br /> <br /> 3. · The County, without cost to the Department, shall provide relocation <br />assistance services and payments for families, businesses, and non-profit organizations <br />being displaced by the project. Such services and payments shall be made in accordance <br />with Public Law 91-646 and the North Carolina General Statutes, Chapter 133, Article 2, <br />Sections 133-5 through 133-17.
