WHEREAS, the County and the Department are authorized by the following <br />legislation: General Statutes of North Carolina, Section 136-66.1, Section 60A-296 and" <br />297, Section 136-18, and Section 20-169, to provide adequate traffic operating controls <br />and control devices for the safe and efficient utilization of highways; and, <br /> <br /> WHEREAS, the Board of Commissioners of the County has approved the <br />construction of said project in accordance with the plans and specifications on file with <br />the Department and has agreed to participate in certain costs thereof in the manner and to <br />the extent as hereinafter set out and has further agreed to the establishment and <br />maintenance of certain traffic operating controls as hereinafter set out. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the benefits accruing to <br />the Department and the County as the result of the construction of said project in <br />Cabarrus County, it is agreed as follows: <br /> <br /> 1. The County shall perform, or cause to be performed, the work hereinafter <br /> <br />set out when the same shall become necessary by reason of the construction of an access <br />road to the new distribution center for Stanley Tools off NC 73; said work to be <br />perforated, or provision made therefor, in a manner satisfactory to and in conformance <br />with rules and regulations of the Department herein referred to: <br /> <br /> (A) The County, without expense to the Department, shall effect all <br />necessary changes, adjustments, and relocations of telephone, telegraph, and electric <br />power lines; underground cables, gas lines, and other pipelines or conduits; or any <br />privately- or publicly-owned utilities. <br /> <br /> (B) The County shall lay, change, relay, repair, and otherwise adjust any <br />county-owned electric, water, sewer, and gas lines, and any other pipelines or conduits; <br />and shall make all necessary adjustments to house or lot connections or services lying <br />within the right of way or construction limits, whichever is greater, of the project, <br />whether said connections or services are owned by the County or by others. <br /> <br />-2- <br /> <br /> <br />
