i~ l~Z~ (the .~eement#) entered into as o~ the 1St day o£ <br />~~, ~h 0~1~, (h~einafter rafted to as <br /> <br />WHERBAS, the County wishes to p~ovide solid waste collec~ion <br />services to i~:s ci~izens; and <br /> <br />WHEREAS, BFI desires to provide such solid waste coXlec~ion <br />services; and <br /> <br />Wtr~Jk~, a~ ~he November ~, 1992 Reel~i~g of the Cab&~rtt~ Cott~y <br /> <br />Board of Commissioners ("Board"), the Board adopted a re~olution <br />granting t:o BFZ the exclusive franch/ss ~-d right ~:o pio~ up, <br />uolleO~, ~ranspo~ and dispose of non-ha~.ardous solid waste <br />residences within the limits of the unincorporated portions of <br />~_-~barrus County; and <br /> <br />W~tEAS, the parties hereto desire to set forth the righe~ and <br />obligetions of t/~e parties in this Agreement. <br /> <br />NOW, THEREFORE. in consid~rat£on of ~h~ p=~mlses, the mu=ual <br />pre~ises and the sum of Ten Doliars ($10.00) and other good and <br />valuable consideration, the parties hereto hereby agree as follows: <br /> <br />1.1 <br /> <br />~ - Large items of solid waste such as <br />£urni=ttrs, large auto parts, trees, branches, stumps, <br />~tove~, refrigera~ors, water tanks, was~ingmac~ines and <br />othe= oversized wastes whose large sise p=ecludes or <br />complicates =~e~r handlln~ by normal solid waste <br />collection, processing or d~sposal methods. <br /> <br />1.2 <br /> <br />~n_O~- Waste building materials rssul~ing <br />from construction, remodeling, -repair or demolition <br />operations. <br /> <br />1.3 <br /> <br />County - All area within the .boundaries of Caba~:~us <br />County not within the corporate limie~ o£ Concord, <br />Barrisburg, Kannapolis, or Mt.
