To provide technical corrections to the original site plans and documents that were <br />submitted to the Board of Adjustment in 2017. <br />2. To provide a revised application, site plan, landscape plan and applicable <br />documents for the Board of Adjustment to consider as a means to remedy multiple <br />Violations on the subject property. Because of the violations, the original conditions <br />of approval for CUSE2017-00001 cannot be met. <br />NOTICE OF VIOLATIONS ISSUSED (GENERAL SUMMARY) <br />1. Violation of Conditional Use Permit 2017-00001 (Condition 6) <br />2. Encroachment violations including clearing within the 100 ft. vegetative buffer <br />3. Arrays/Racking placed within the 100 ft. setback buffer <br />4. Waterbody Buffer Zone violations along and across Bost Creek <br />5. Floodway and non-encroachment area has been disturbed along and across Bost <br />Creek <br />6. Waterbody Buffer Zone violations around identified wetlands <br /> <br />The Board of Adjustment needs to determine if the new landscape plan, proposed plan <br />for remediation of the stream buffers, wetland buffers and floodplain encroachment, and <br />updated documents provided are adequate to address site compliance for the Violations <br />issued on the site and to meet the original intent of the conditions outlined in <br />CUSE2017-00001.
