If you recall from the site visit, there <br />was some areas where it was obviously temporary fencing. This is through a sediment basin. <br />Once the basin is decommissioned, the permanent fence will be put in place and put in place in <br />the proper lines. <br />The Chair said where are you going to move the fence on the west side of array number 2? <br />Mr. Jansen said well, it is a commitment to have it done by the end of this month, so, we will <br />follow up and push on it. <br />The Chair said the encroachment in the Edgefield Road extension area and that will be moved <br />too; is that this month? Looks like array 01, around array 01, west side of array 01 ? You have <br />identify encroachment, as stated, the fence will be moved. <br />Mr. Jansen said around array? <br />Mr. Dagenhart asked Ms. Morris to put up the Eastfield survey. <br />Ms. Morris said you want to see the Eastfield side or you want to see the Whispering Pines side? <br />The west side? <br />The Chair said the west side. <br />Mr. Jansen said the west side, the Edgefield Road side, again, it is the commitment to have that <br />moved by the end of this month. <br />Mr. Dagenhart said AI, I am sitting here looking at this and I understand that there is a curvature <br />there from your property line, but measuring your surveyor's plan, north of the encroachment, <br />you are approximately 100, south of the encroachment you are like a 130 feet from the fence <br />line. So, I am not sure your surveyor; I think he's got you in the wrong. I mean, I think you are <br />out of the 100-foot. <br />Mr. Jansen said yeah, that has been very dynamic, and a lot of back and forth and questioning on <br />that also. Part of that is the determination of the actual right-of-way of the road. <br />Mr. Dagenhart said right, so, if! measure from where the bearing is for north 4159.27 to the <br />buffer, you are at 100 feet. If I go down to line L-16 and measure, I am at 132. I checked the <br />scale and the scale is proper on the drawing. I am curious, if it is truly off that property line, then <br />I do not know that there is an encroachment there. <br />Mr. Jansen said, I can go back to the surveyor and question him again on this. I appreciate you <br />pointing that out. If we are right, we are right and if we are wrong, we will move it. <br />42
