EXHIBIT 1 <br />FINDINGS OF FACT <br />Conditional Use Permit Application <br />Unica UBO <br />CUSE 2019-00001 <br />1. The use as proposed is not detrimental to the public health, safety or <br />general welfare. <br />The uncontroverted evidence shows a need for enhanced cellular telephone <br />service in this area. This is of use to the residents of the area and to first responders to <br />emergencies. The tower will be constructed by certified engineers and contractors and <br />will meet ANSI standards. The Board also adopts as findings the assertions of the <br />applicant in this section of its project narrative and statement of compliance. <br />2. The use as proposed is appropriately located with respect to <br />transportation facilities, water supply, fire and police protection, waste disposal, etc. <br />All such facilities, most of which are not required for this unmanned cell tower, <br />are located nearby. The Board also adopts as findings the assertions of the applicant <br />in this section of its project narrative and statement of compliance. <br />3. The use as proposed will not violate neighborhood character nor <br />adversely affect surrounding land uses. <br />The proposed location for the cell tower is located at a place on the tract that is <br />heavily wooded, reducing any physical obtrusiveness to surrounding landowners. All of <br />the surrounding tracts have residential zoning classifications. The tower will not have <br />lights. The Board also adopts as findings the assertions of the applicant in this section <br />of its project narrative and statement of compliance. <br />4. The use as proposed will comply with the general plans for the physical <br />development of the County as embodied in the Zoning Ordinance or in the area <br />development plans that have been adopted. <br />The use as proposed will serve part of the northwest area of the County, where <br />the County contemplates future growth and is consistent with the County's plans for <br />development in that area. The Board also adopts as findings the assertions of the <br />applicant in this section of its project narrative and statement of compliance.
