Attached hereto as Schedule 1 is a chart which sets forth total School Facility building <br />space and total School Facility grounds, which shall be amended from time to time to <br />incorporate changes in such figures. <br />(c). School Park Facilities. <br />Implementation of this agreement is contingent upon the Cabarrus County Board of <br />Commissioners allocating funds in each Fiscal Year's Annual Budget. These funds once <br />approved will be utilized exclusively for maintenance and repairs to school park facilities <br />on Cabarrus County Schools and Kannapolis City School sites. The Cabarrus County <br />Schools Chief Finance Officer will maintain this fund and a report will be issued quarterly <br />showing all disbursements. ALPS will be provided the account balance and other details <br />regarding this account at any time upon request. If the cost of repairs on any individual <br />work order exceeds $2,000, the Director will notify the ALPS. Once the remaining <br />budget balance reaches $5,000 or less, the Director will advise the ALPS so that <br />additional funds can be requested if needed prior to the end of the contract year. A list <br />of the current Athletic Field Sites /Facilities covered under this Agreement is listed on <br />Schedule 2. <br />9. Accounting - The Cabarrus Board Finance Department will be responsible for <br />establishing two separate internal accounting categories and will keep separate <br />accounting records as to amounts actually spent for the Services provided for each of <br />the Cabarrus Board and the Kannapolis Board with regard to the above: (i) Building and <br />Facilities Services; and (ii) Grounds and Maintenance Services. Within thirty (30) days <br />after the end of each quarter, the Cabarrus Board Finance Department will prepare a <br />report showing spending by the Department, which report will be sent to the County <br />Manager and the Superintendents. At the end of each fiscal year, unspent funds in <br />either Board's account, whether in building maintenance and facilities or grounds and <br />maintenance, shall be reserved for subsequent years' budgets and shall only be spent <br />for each respective purpose, subject to agreement by the Parties. <br />10. Disputes - In the event any disputes arise in connection with this Agreement, the <br />Parties shall make an earnest, good faith attempt to resolve their differences prior to <br />implementation of more formal measures for resolving such disputes. <br />11. Termination - This Agreement may be terminated without cause by any Party by <br />providing written notice of termination as of June 30 of any year, provided such written <br />notice is delivered to the remaining Parties at least six (6) months in advance. <br />12. Severability - If any portion of this Agreement is held invalid, illegal or <br />unenforceable, such determination shall not impair the enforceability of the remaining <br />terms and provisions, provided the purposes, intent and objects of this Agreement may <br />be attained and achieved through the enforcement of such remaining terms and <br />provisions. <br />Page 6 of 9 <br />G -6 <br />Attachment number 1 <br />Page 206 <br />
