Multi-Jurisdictional <br /> <br />1.4.4 <br /> <br />1.4.5 <br /> <br />Zoning and Subdivision Ordinance <br /> <br />for the purpose of explaining the procedures, operation and effect of the <br />APF standards; the role of the service providers other than the Cities, <br />County or Towns in reviewing development applications for compliance <br />with the APF standards; and, building support for the implementation of <br />the APF standards. Service providers included in the meetings shall include <br />the Water and Sewef Authority of Cabarrus County (WASCC), Regional <br />Water Resources, the Cabarrus County School District, the Kannapalis <br />City School District, the Rowan County School District, the North Carolina <br />Department of Transportation, and Browing-Ferris Industries (BFI) and local <br />murdcipal solid waste collectors. <br /> <br />Initial Determination of Procedural Requirements of Al>i* standards <br />FL&C shall assist staff in identifying the most appropriate points in the <br />various development approval processes when the APF standards should <br />be applied; whether the public facilities determination should be tentative or <br />final; whether the determination will trigger a "reservation" of capacity; <br />how the determination of whether facilities are adequate will be <br />coordinated with other aspects of the development approval process, <br />including the payment of impact fees; to what categories of development or <br />development approval the requirement will apply; whether any land use <br />types or development approvals will receive preferential treatment; <br />whether, and if so, who will be authorized to grant waivers or exemptions <br />from the APF standards; what process will be incorporated for appeals <br />from adequate public facilities determinations; what is the effect of failure <br />to meet one (1) or more LOS standars for public facilities; what conditions <br />may be attached to a favorable adequate public facilities determination <br />including, but not limited to, deferral of development, phasing of <br />development, reduction in density/intensity of development, and mitigation <br />by the developer of public facility deficiencies; which City or County staff <br />will be responsible for the adequate public facilities review and <br />determination; and how the review and determination will be integrated <br />with the development approval process. <br /> <br />Initial Determinations of Applicable Level of Service (LOS) Standards <br />FL&C shall assist and work with appropriate staff to establish reasonable <br />and appropriate level of service (LOS) standards for each public facility <br />and service to be included in the APF standards. For public facilities and <br />services provided by service providers other than a City, County or Town, <br />FL&C and City staffshall consult with and obtain input from such service <br />providers before recommending a level of service (LOS) standard.
