just wanted a nice residential area to live, and that is what they would like to
keep.

Mr. ]oyle said Mr. Peterman said something about a entrance from Highway
601. Mr. Joyle said he cannot do that because that is illegal. He would have to

come orr k-al IJost KoaCl.

Mr. Marshall said our Thoroughfare Overlay Zone requires on corner lots with
lots of record that the access point be from the lower classification road (the
minor road), which in this case is Cai Bost. We added, because of the variances
we are going through, that an additional access point may be approved at the
discretion of the Zoning Administrator. That has always been after the review of
NCDOT. Under the Thoroughfare Overlay Zone, the initial requirement would
be Cai Bost Road, but if requested, the Zoning Administrator would review it for
possible access point from Highway 601.

Mr. Duane Barron, Property Owner, addressed the Board stating Duke Power
has a right-of-way right behind his house. He said Mr. Peterman can technically
be within 20 feet of his house if he wanted to put something all the way back
there. He said the traffic will have to come through Jim $ossoman Road. Mr.
Barron said in considering the other case, and considering this being under
appeal, it might just be wise for this Board to consider that other court case.

Mr. Copeland said he could have sold quite a few lots that he did not sell
because he wanted to keep decent people there. He did not want hoodlums
moving in.

The Chair said to Mr. Little that he was sworn in to speak, and he asked Mr.
Little to come forward.

Mr. Drye asked Mr. Little how long he has been in business?

Mr. Little said 60 years.

The Chair then swore in Mr. Jack Garmon.

The Chair asked Mr. Garmon if he was co-owner of the property? He also said
to Mr. Garmon that he is also a part of this suit to keep the other adjoining
property from being rezoned. He asked Mr. Garmon to explain that to him.

Mr. Garmon said he signed the petition because he did not think that it would be
good for the community to put those buildings there. He said they would like to
keep their community in good shape.
