January 30, 2019 <br />Page 3 <br />to regulate towers and antennas, as stated in the FCC & FAA <br />Compliance Letter by David Herring of SCI Towers, attached hereto <br />as Exhibit "2" and incorporated herein by reference, and as further <br />provided in the FAA Determination of No Hazard to Air Navigation in <br />Exhibit "7". <br />f. BUILDING CODES, SAFETY STANDARDS-To ensure the structural integrity of <br />towers and antennas, the owners of such facilities shall ensure that they are <br />maintained in compliance applicable with standards contained in the State <br />Building Code. <br />The proposed wireless telecommunications facility will be maintained <br />in compliance with applicable standards contained in the State <br />Building Code. <br />g. FALL ZONE-Towers shall be designed so that in the event of a structural failure, the <br />tower falls on the subject parcel or within the leased area of the subject parcel. No <br />tower or antenna shall be designed and/ or sited such that it poses a potential <br />hazard to nearby residences or surrounding properties or improvements. To this <br />end, any tower or antenna, not located a distance equal to the height of the tower <br />plus 50 feet away from all property lines or other towers, shall be designed to <br />withstand the maximum forces expected from wind and ice when the tower is <br />fully loaded with antennas, transmitters and other equipment. Compliance with <br />this requirement shall be certified by a professional engineer licensed by the State <br />of North Carolina in a report describing the tower structure, specifying the <br />number and type of antennas it is designed to accommodate, providing the basis <br />for the calculations done, and documenting the actual calculations performed. <br />As shown on Sheet C1 of Exhibit "1", the proposed tower is located at <br />least its height plus 50-feet from all property lines or other towers. <br />h.ESSENTIAL SERVICES-Wireless telecommunications towers and antennas shall be <br />regulated and permitted pursuant to this chapter and shall not be regulated or <br />permitted as essential services, public utilities, or private utilities. <br />The Applicants accept and acknowledge this provision. <br />i. SIGNS-Signs on a tower, or on any portion of the premises leased for wireless <br />communication use, shall be limited to those needed to identify the property and <br />the owner and to warn of any danger. Signs which advertise for commercial <br />purposes are prohibited. All signs shall comply with the requirements of Chapter <br />11, Signage. <br />Signs for the purpose of identification, warning, emergency function, and <br />contact will be placed as required by applicable state and federal law. <br />Examples of such signs and other signs required by the FCC can be found on <br />Sheet Cs of Exhibit "1".
