<br />7 <br />Staff Comments (based on materials provided in hard copies to staff since the February <br />meeting) <br />1. Letter from Kleinfelder dated February 18, 2019-response to FEMA data <br />section does not read correctly. Revise <br />2. Cover letter from Kleinfelder does not describe the reason for the flood <br />development permit which is after the fact permitting for floodplain <br />encroachments and the proposed restoration of the floodplain to pre- <br />construction conditions. <br />3. Highest BFE that Staff can find on site using best available data is <br />504.1.Applicant references the BFE at the closest cross section of the <br />Rocky River, not the floodplain on site. Correct application and letter. <br />4. Certification that all fill materials has been removed from the 100 year <br />floodplain and that the disturbed areas have been stabilized to withstand <br />erosive forces will be required for the project. <br />5. Applicant must provide revised information as requested. <br />GLARE STUDY <br />The Applicant provided a revised Glare Study (Revision 6, dated 2/20/2019). Section <br />3.0 has been updated to provide additional information based on the questions asked <br />by the Board and comments provided by the County Engineer. <br />During the site visit, the Board expressed concerns for glare related to the Widenhouse, <br />Bender and McManus properties as well as lots 108-92 as shown on the landscape plan. <br /> <br /> If the Board decides that the Glare Study and mitigation measures are adequate, <br />the Board should enter that information into the record and consider the next <br />item. <br /> If the Board decides that the Glare Study and mitigation measures are not <br />adequate, the Board needs to provide specific direction to the Applicant for <br />compliance. <br />LANDSCAPE PLAN/STREAM/WETLAND BUFFER REMEDIATION PLAN (SEE SITE <br />PLAN/LANDSCAPE PLAN) <br />The Board of Adjustment must decide if the proposed landscape plan and <br />stream/wetland restoration plan meets the intent of the original approval and is <br />adequate to clear the Notice of Violations if implemented on site: <br /> Encroachment violations including clearing within the 100 ft. vegetative <br />buffer <br /> Arrays/Racking placed within the 100 ft. setback buffer <br /> Waterbody Buffer Zone violations along and across Bost Creek <br /> Waterbody Buffer Zone around the identified wetlands
