Planning and Zoning Commission <br />Minutes <br />March 12,2019 <br />The Chair asked ifthere were any other questions or comments. He said it is almost 10, but I <br />think we can go on. With this one, Susie, I do not know if you want to address this one, fence <br />placement and panels? <br />Ms. Morris said just so you know, this clock is correct. It was changed and it is only 9:00; it is <br />not almost 10:00. <br />The Chair said right. <br />Ms. Morris said when staff provided comments back to the applicant, there were several areas <br />that were noted for potential encroachments. Mr. Krimminger's Noticed of Violation included <br />potential fence, racking and panel encroachments. Mr. Krimminger is here if you have any <br />questions for him. The two times that we were at the site, there were some encroachments, or <br />potential encroachments that were identified; and then our engineer also had some <br />encroachments that were identified as part of their review. <br />We will start with Edgefield. There is a question about Edgefield and where the pin (survey pin) <br />is for that road, actually turns a curve or creates a curve. So, you can see right here (indicating), <br />this was provided in the pictures that staff had given to you. I am not sure at this point what <br />meeting it was. But, you can see right here that this panel --this is the fence right here. <br />It was identified on Edgefield that there is an encroachment of the fence into the buffer. You <br />have a signed and sealed letter from Rufus Love, Surveyor, stating that this panel and racking is <br />right at the edge of that fence, but, that it did not encroach into the fence. With that particular <br />one, the applicant has identified that encroachment and they have told us that that fence will be <br />moved in that area. They also will be looking at the landscape in that particular area. They <br />provided a timeline; this timeline was actually provided by DEPCOM, as the contractor that <br />would be doing the work to move the fence. <br />The Gantt chart shows that this work would be completed by April of 20 19, and there is a <br />representative, again, here from DEPCOM if you have any questions about any of the timelines <br />or anything that were submitted. <br />On the other side of the Bost property, at Whispering Pines, there was an encroachment that was <br />identified (she showed the fence). Mr. Jansen can speak to this, if you are interested in hearing <br />about it. Some of this fencing in this area is not permanent fencing, so they acknowledge the <br />encroachment and they have said that they will move the fence so that it is out of the buffer. <br />Then they will deal with the landscape in there where there is that little bit of an encroachment. <br />As you make your way down towards the west side of array number 4, this is coming down <br />through Vanderburg Estate. There were concerns about the Hartsell property. Rufus confirmed <br />that there were no encroachments there. Also, next to the Watson property, there were no <br />encroachments; on the west side of array 4, there were no encroachments and then on the east <br />side of array number 15. <br />40
