Planning and Zoning Commission <br />Minutes <br />March 12,2019 <br />agreed upon and preferred location for the tower site. <br />The subject property is located in the Western Planning Area. This subject property is <br />designated as Low Density Residential. <br />Should the Board of Adjustment grant approval of the Conditional Use Permit, Staff requests the <br />following conditions become part of the approval and case record: <br />1. Site plan review and approval is required subsequent to Board of Adjustment approval in <br />order to ensure compliance with all applicable development requirements and conditions. <br />2. The Granting Order, stating restrictions and applicable conditions of approval shall be <br />recorded with the deed for the property and prior to zoning permitting. <br />3. The applicant shall procure any and all applicable federal, state, and local permits prior to <br />zoning permitting. <br />4. Any proposed future expansion of property, as well as modifications or changes to <br />approved site plan, must receive Board of Adjustment approval in the form of an <br />amendment to the Conditional Use Permit. <br />5. The applicant shall provide copies of all state, local, and federal permits for the <br />permanent project file prior to zoning permitting. <br />6. Applicant shall provide a Removal Bond pursuant to Section 11, Removal of Abandoned <br />Antennae and Towers, prior to zoning permit approval. <br />7. Applicant shall update the site plan prior to zoning site plan review to ensure that the <br />driveway will support a 75,000 pound fire apparatus. <br />8. Applicant shall comply with all applicable terms ofNCDOT Driveway Permit C-I806, <br />including adding the required site triangles to the site plan. <br />The Chair asked if there were any questions for Staff. <br />The Chair said on the landscaping plan, it says existing trees\landscaping are sufficient to screen <br />the compound from adjacent parcel. He is assuming it is where the tower goes in from the <br />adjacent parcel. He said is this the time to ask you or the applicant question <br />Mr. Collins said you may want to ask the applicant but, it is his understanding and seeing aerial <br />photos, that it is pretty heavily included around that site. <br />There being no further comments or questions for Staff, the Chair called on the Applicant. <br />Mr. Frank Longest, Jr., Attorney, Holt, Longest, Wall, Blaetz and Moseley, of Burlington, NC. <br />Our firm serves as North Carolina counsel for the applicant. The purpose of his being here is to <br />introduce his good friend Jonathan Yates. Mr. Yates is an attorney in Charleston, South Carolina. <br />Most of us in the cell phone arena know Mr. Yates as the guru of cell phones. Mr. Yates literally <br />has made application for many hundreds of cell phone towers. He is the author of the application <br />here tonight. <br />7
